DogMap website and mobile apps

DogMap is an interactive online app that allows you to mark on a map how dog-friendly or assistance dog-friendly public places are.

DogMap is available via the web at https://map.pfotenpiloten.org (hereinafter the “Website”) and as a mobile application (hereinafter the “App”) for the operating systems or smartphones mentioned on the Website. DogMap is operated by Pfotenpiloten, a German nonprofit organisation.

The following provisions govern your use of the Website and the App. By visiting the Website, you agree to the following terms of use. By voluntarily registering as a user, you have also expressly agreed to these terms of use.

USE OF DOGMAP

Users of the app can retrieve information about the dog or assistance dog friendliness of the locations entered on the DogMap without registration and mark locations on the DogMap. You do this by changing the status of a location entered on the DogMap, e.g. from red (no assistance dogs allowed) to green (all dogs allowed).

It is also possible to leave information about personally known locations on an answering machine at 0049-69-1532016-66 or to email it to [email protected] The Pfotenpilotenteam will then make these entries for you.

Users who mark locations on DogMap transfer an irrevocable unrestricted right of use of these location markings to Pfotenpiloten. Pfotenpiloten stores this location data in a database and makes it available to other users on DogMap or via the central accessibility project of Sozialhelden e.V., accessibility.cloud. We may share the markings on the map with other projects, such as other accessibility projects.

For further use of the website, especially to have an overview of which places on the DogMap have been entered by you personally and to be recognized for your entries, for example in a competition, you have to create a user account. The required login and registration process is designed to be as minimal as possible and is self-explanatory. Registrations must be confirmed by clicking on the link in the confirmation email.

Only places accessible to the public, e.g. stations, authorities, restaurants, clinics and shops, may be entered on the DogMap. Apartments and rooms of companies and authorities that are not accessible to the public should not be marked. You are obliged to mark places and the status of the created places truthfully. Incorrect markings can and will be deleted as soon as we are informed. Furthermore, we reserve the right to undo entries and changes made by users who repeatedly create or mark places incorrectly, either in whole or in part, and to delete their user account if necessary.

In order to protect the data from spam entries, the database registers an electronic fingerprint of the device with which a marking was performed and stores it together with the entry. This data is completely anonymous and is not suited for tracking the user’s location or identity. Its sole purpose is to be able to clear the app of spam or erroneous entries in case of misuse.

The accuracy and timeliness of the entry and marking of places by users of DogMap is not checked and not monitored by us. In addition, after the registration or marking of a location, changes may occur which have not yet been taken into account on the DogMap and of which we likewise have no knowledge. We can therefore not assume any responsibility for the correctness or up-to-dateness of all markings and are not liable for this in any way. In this respect we are also dependent on your cooperation. If you find that a place is incorrectly entered or marked, you can simply correct the marking yourself by selecting the correct classification.

DogMap may only be used in a contractual and lawful manner. Users may not use any measures, mechanisms, software, scripts or sniplets in connection with the use of DogMap that may interfere with the functioning of the website or app. You may not take any measures that could result in an unreasonable load on the website or the App.

DogMap is based on data from Google Maps. We are not responsible for information, data and images managed by Google that appear on DogMap and have no influence on their accuracy. LICENSE

Use of DogMap is free of charge. Entries made by users of DogMap are subject to a public license, regardless of whether the user was logged in with his own account or entered it anonymously. The collected data, including corresponding links and comments, are offered by Pfotenpiloten with open license and shared with other projects. APPLICABLE LAW AND JURISDICTION

This agreement is subject exclusively to the law of the Federal Republic of Germany. Insofar as the User is a merchant, a legal entity under public law or a special fund under public law, the sole place of jurisdiction for all disputes arising from or in connection with this Agreement shall be the respective registered office of Pfotenpiloten. Insofar as the User has no general place of jurisdiction (in the case of persons whose place of residence or, in the absence thereof, their whereabouts; in the case of legal entities, the registered office) in the Federal Republic of Germany, the respective registered office of Pfotenpiloten is also agreed as the exclusive place of jurisdiction for all disputes arising from or in connection with this agreement; however, insofar as another place of jurisdiction is permitted in addition to or exclusively by virtue of mandatory law, that place of jurisdiction is also or exclusively decisive.

CHANGE OF THE TERMS OF USE

All users are subject to the terms and conditions of use that are current at the time of the respective use of the website or app and that are available on the website.  We may change these Terms of Use at any time with effect for the future. Fundamental changes, especially those concerning the use of data, will be sent to you by email one week before they come into effect, provided that you have created an account with DogMap. Otherwise, we will inform you of such fundamental changes when you visit DogMap, for example by means of a push message when you use the app. You are free at any time to stop using DogMap or to request deletion of your user account.
